Terms of Service

Effective date: 1st May, 2026

1. Acceptance of Terms

By accessing, registering for, or using any services provided by Mayan.Host (operated by Samyojaka Software, a company incorporated under the laws of India), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations, including the Information Technology Act, 2000 and data protection regulations applicable in India and jurisdictions where your data may be processed.

If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Services

Mayan.Host provides engineering-driven cloud infrastructure and DevOps services, including but not limited to:

Core Service Categories

A. Managed Cloud Infrastructure

  • Private Cloud Hosting (on-premises or hosted)
  • Managed Kubernetes clusters
  • AWS cloud optimization and managed services (as AWS Partner)
  • Hybrid cloud architecture design and implementation
  • 24/7 monitoring, alerting, and incident response
  • Backup, disaster recovery, and failover management

B. DevOps & Site Reliability Engineering (SRE)

  • CI/CD pipeline design and implementation
  • Infrastructure as Code (Terraform, Ansible, etc.)
  • Production incident response and root-cause analysis
  • SLO/SLI definition, observability, and monitoring
  • Capacity planning and performance optimization

C. Cloud Architecture & Consulting

  • Cloud infrastructure audit and cost analysis
  • Architecture design for private, AWS, or hybrid environments
  • Security, compliance, and data residency assessments
  • Cloud migration and optimization planning
  • Reliability and scalability assessments

D. Team Augmentation & Staffing

  • On-demand DevOps engineers
  • Site Reliability Engineers (SREs)
  • Cloud architects and infrastructure specialists
  • Short-term, long-term, full-time, or part-time engagement models
  • Knowledge transfer and documentation support

E. Managed Support Services

  • 24/7 monitoring and alerting
  • Patch management and infrastructure upgrades
  • On-call engineering support with defined SLAs
  • Production incident escalation and resolution

Services are delivered either remotely, on-site, or through a hybrid model as agreed in your Service Agreement.

3. Description of Services

3.1 Service Scopes

Each engagement is governed by a separate Service Agreement, Statement of Work (SOW), or signed proposal that defines:

  • Specific services, deliverables, and timelines
  • Resource allocation and engagement model
  • Service levels, SLAs, and success metrics
  • Pricing, payment terms, and billing schedule
  • Support hours and escalation procedures

These documents supersede generic descriptions and constitute the binding contract for services.

3.2 Engagement Models

Mayan.Host offers services under multiple engagement models:

  • Project-based: Defined scope with fixed or time-and-materials pricing
  • Managed services: Ongoing infrastructure operations with monthly recurring fees
  • Hybrid: Combination of managed services and project work
  • Team augmentation: Dedicated engineers working within your team

Pricing and terms vary by model and will be specified in your signed agreement.

3.3 Non-Binding Consultations

Initial consultations, architecture reviews, and preliminary assessments may be offered at no charge and are non-binding unless explicitly formalized in a signed agreement.

4. Your Account and Security

You agree to:

  • Keep your login credentials confidential
  • Notify us immediately if your account is compromised
  • Implement strong passwords and multi-factor authentication
  • Limit access to only what you authorize
  • Revoke our access immediately when your engagement ends

We commit to:

  • Implement industry-standard security practices
  • Maintain strict confidentiality of your data
  • Notify you promptly if we discover a security breach
  • Follow documented security procedures in your SOW

5. Acceptable Use

You agree not to use our services to:

  • Violate any laws
  • Transmit malware or harmful code
  • Conduct denial-of-service (DoS) attacks
  • Engage in unauthorized access to systems
  • Host illegal gambling, illegal adult content, or explicitly illegal activity
  • Violate cloud providers' (AWS, GCP, Azure) acceptable use policies

Violation may result in immediate suspension of services.

6. Service Levels and Uptime

Service level commitments apply ONLY if you have a signed SLA. If you don't have an SLA, services are provided on a best-efforts basis without uptime guarantees.

If we fail to meet your SLA:

  • Your sole remedy is a service credit (percentage of your monthly fee)
  • Service credits are NOT refunds
  • You waive the right to claim damages for downtime

We are NOT liable for downtime caused by:

  • Your code, configurations, or actions
  • Third-party failures (cloud providers, ISPs, DNS, etc.)
  • Force majeure (natural disasters, government actions, pandemics, terrorism)
  • Denial-of-service attacks
  • Issues beyond our control

7. Payment and Billing

  • Invoices are issued according to your SOW schedule
  • Payment is due Net 30 days from invoice date (or as your SOW specifies)
  • Late payment may result in service suspension after 10 days' notice
  • All fees exclude taxes (you pay applicable GST, VAT, etc.)

Refunds: Services are generally non-refundable once work begins. Specific refund scenarios are defined in your SOW.

8. Your Data

You own your data. We don't claim ownership of anything you provide to us.

We access your data only to deliver the services you've hired us for. We keep your data confidential and secure.

When your service ends:

  • We'll provide your data in an agreed-upon format within 10 business days
  • We'll securely delete your data within 30 days of your request
  • You're responsible for long-term data archival

9. Our Intellectual Property

We own our tools, processes, and methodologies. You can't copy, distribute, or reverse-engineer them.

You own your data and custom work. Work created specifically for your infrastructure is yours upon payment. Pre-existing templates and frameworks are ours, but you can use them for your systems.

10. Liability and Disclaimers

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

11. Termination

Either party may terminate services with appropriate notice. Upon termination, you will lose access to services and data may be deleted according to our data retention policies.

12. Confidentiality

We keep your information confidential. We won't share your data, architecture, or business information with third parties without your permission.

Exceptions: We may disclose if required by law, court order, or to prevent illegal activity.

If we're acquired or merge with another company, we'll notify you. If the buyer is a direct competitor (another cloud/DevOps company), your data won't be transferred without your written consent.

13. Dispute Resolution

Disputes are resolved through:

  • Good faith negotiation (30 days)
  • Mediation (if negotiation fails; non-binding)
  • Binding arbitration under Indian law in Bangalore (if mediation fails)

We won't resolve disputes through class action lawsuits. All disputes are handled individually.

14. Governing Law

These terms are governed by the laws of India. The Information Technology Act, 2000 applies.

For GDPR compliance, a separate Data Processing Agreement is available if needed.

15. Changes to These Terms

We may update these terms with 60 days' notice for major changes (like pricing or liability).

Continued use of our services means you accept the new terms.

Minor changes (clarifications, process improvements) take effect with 30 days' notice.

17. Final Note

These are baseline terms for the website. Your actual rights and obligations are defined in your signed Service Agreement or SOW, which may be different from (and supersede) these general terms.

If you have a signed agreement with Mayan.Host, that agreement controls.

If you don't yet, these terms apply to your initial consultation and evaluation period.
